Several factors influence an IME report delivery timelines, and it can be one of the most significant challenges for claims managers and lawyers working to tight deadlines. 

Delivery timeframes greatly depend on:

We thought it would be helpful to share three real-life examples that show insights into the IME process and all the things that can influence IME report delivery turnaround times.

Example 1 – A Complex Personal Injury Case

A Personal Injury Lawyer required that an independent medical examination (IME) be performed on their client to determine the nature and severity of multiple injuries they sustained in a car accident, and what long-term impact they would have on their capacity to live and work in the future. 

The IME was promptly scheduled, and the examination was completed within two weeks. The medical expert was unable to calculate the degree of permanent impairment relating to the injuries sustained as pathology, and specialised radiological investigations were not available, and in fact, no testing had ever been performed. Red Health liaised with the lawyer and the examinee underwent the required testing at the first available time which resulted in a three week delay. The delivery of the final report took approximately five weeks.

To ensure that all of the essential information was acquired as quickly as possible, Red Health supported the lawyer and examinee with respect to identifying the type of testing required and the best approach to obtaining the referral forms which was aimed at avoiding additional costs for the examinee. Red Health maintained communication with the medical expert so that when the results were available they could do the final touches of their medico-legal report. 

Given the nature of this case, a comprehensive and accurate report was received in a reasonable timeframe, given the need to obtain further information to proceed. However, it could have been resolved quicker if a strategic review of the case had been completed by the Medico-Legal provider from the start – something that Red Health proudly offers.

Example 2 – A Swift Workers’ Compensation Claim Resolution

A organisation needed to assess an injured worker’s capacity to return to regular work duties in accordance with WHS guidelines. The appointment for the Independent Medical Examination was scheduled one week following the request. The medical brief included records from the workers treating doctors and up to date radiological investigations. The objective to the IME was focused around whether the worker could return to work and safely perform the inherent requirements of their role at pre-injury hours and if there were any limitations or restrictions in performing their duties.

Due to the uncomplicated nature of the case and the early submission of the medical brief, the independent medical examiner was able to dictate their draft report on the appointment day and the necessary quality assurance reviews were completed by the medical examiner and Red Health’s in-house QA team in a timely manner. This report was issued to the client within 6 working days.

The streamlined communication between the involved parties, including the employer, examinee, examiner and Red Health, allowed for a fast report delivery and worker’s compensation claim resolution.

Example 3 – A Permanent Disability Insurance Case

An insurance agency needed to determine the level of injury, and its long-term impact, in a disability claim. In light of the complexity of the case and the intricate nature of the claim, multiple IMEs were required, and the selection of experts was crucial. It took several weeks to identify the right medical and allied health professionals and secure bookings with them in the best order.

Recognising the need for a comprehensive assessment to be made, a range of assessment bookings were made across specialities, including neurology, psychiatry and with an occupational therapist.

After the assessments were completed, the practitioners completed their reports and received the report of the previous practitioner so they could draw upon relevant information to help them provide their opinion.  Red Health supported the quality assurance process and ensured the insurance agency was informed each step of the way until the reports were finalised and issued to the client.

In total, the entire process took approximately nine weeks to conclude.

This approach ensured a robust and holistic assessment outcome for the examinee, which, in turn, allowed the insurance agency to determine the appropriate level of funding for the examinee which considered multiple practitioners from different specialities. This approach was valued by the client as it delivered on clarity and reduced timeframes which was required given the complexity of the disabilities.

If the provider allows support people, it may be permitted for specific parts or all of the appointments and this can differ with each medical expert. In contrast, some IME providers will ask that support people remain in the waiting room. The type of Independent Medical Assessment will also determine whether having a support person is suitable.

Most providers will have information about their policies and guidelines on their website or through their customer service department. Here are your most common medico-legal FAQs answered. 

1. What should I expect at an IME consultation?

You will be asked a host of questions about your history from your education and employment, previous medical conditions, symptoms you’re experiencing from your condition or injury, and any previous or current medical treatments. Examinees are encouraged to answer truthfully so the independent medical practitioner can fully understand the injury’s extent and the short and long-term implications.

2. When should I arrive and what should I bring/wear?

Ideally, you should arrive at least 15 minutes prior to your scheduled time. It’s essential to bring any X-rays, CT or MRI scans, and reports relating to your condition or know where those investigations were performed so we can gain access if required. A list of any medications and supplements you take is also handy. Have photo identification with you such as your passport or driver’s licence. Wear comfortable clothing including underwear that allows you to move freely if it’s a physical assessment. You may be asked to change into a gown to help facilitate the physical testing.

3. What should I expect from a physical examination?

The independent medical practitioner will closely and carefully examine the injured area and conduct non-invasive testing to assess the injury severity and how it affects your functional capacity. This is why wearing loose, comfortable clothing is essential. A chaperone can be provided during your physical examination – please let us know of this request prior to the appointment wherever possible. 

4. How long will the appointment take?

Contact the Client Services Team to ascertain this, as it depends on the injury or condition. Expect a minimum of 45 minutes, however some appointments can take several hours.

Arriving 15-20 minutes early will enable you to complete any necessary paperwork and our medical experts have a good track record for running on time. We will take all steps possible to facilitate your assessment in a timely manner and will update you if we anticipate any delays as best we can on the day.  

5. What can I expect from a virtual assessment?

Designed for individuals who aren’t able to travel, it’s the same as the above but from the comfort of your local consulting room (which Red Health helps arrange). You’ll need to ensure you have a stable WiFi connection for your laptop or desktop and the microphone and speakers work – we will help to test your equipment prior to the appointment. For assessments where a physical assessment is required, we will arrange for an allied health practitioner such as a physio to attend the appointment with you. They will support the medical expert in conducting the physical components of your assessment under the expert’s supervision.

A medical expert is just a hired gun with a biased opinion 

A common myth is that medico-legal providers seek to prioritise financial gain over ethical and professional standards, leading to biased or misleading reports. This has led to allegations of hired guns or insurance agency puppets positioned to provide evidence that naturally supports the respondent as opposed to impartial and objective medical opinions and seeking truth and justice in the case.

The majority of medico-legal experts are highly qualified and committed to providing impartial, evidence-based reports. Whilst there is a commercial element involved when medical specialists make the leap into medico-legal work, they often choose this path because they want to diversify their practice and use their expertise in a different way. Medical experts are bound by professional and legislative codes of conduct and ethical standards to provide accurate, unbiased opinions based on the available evidence. 

The medico-legal industry is no different to other industries – there is a small minority of medico-legal experts that may deviate from best practice when it comes to providing their medical opinion. How this is managed and addressed really comes down to how that expert is engaged and utilised in the medico-legal industry by the referring client. 

Medical experts are specifically chosen based on factors such as years of experience in profession, special interest areas, reputation, court experience, knowledge of claim process, willingness to accept complex cases, location, availability, report turnaround times, consistency of opinion and many others.

An IME is just like going to your doctor

Another common medico-legal myth is that an Independent Medical Examination is just like seeing your General Practitioner.

This is not the case and here is why –

An independent medical examiner is a medical specialist that has undergone medico-legal based training and accreditation to provide their medical opinion and is known as an expert witness. This means that they are bound by the Expert Witness Codes of Conduct and their duty is to the Court – not the individual being assessed or insurance company or the legal representative. They are unable to provide any treatment to the individual being assessed, therefore, no patient/doctor relationship can exist and may be deemed a conflict of interest depending on the nature of the referral, and can put their ability to be impartial under the spotlight. 

In a GP setting, the individual being seen is known as a patient. The GP’s role is to provide ongoing advice on the prevention, intervention and management relating to any health related matters. They are typically viewed as an advocate for their patient as they have a duty to provide their services in the best interest of the patient.
