In his recent <a href="https://www.youtube.com/watch?v=9-vRe-B_SbM" target="_blank" rel="noreferrer noopener"><strong>Red Talk</strong></a>, Dr Marcus Gurgius, a leading Pain Medicine Physician, shared his expertise on the intricate nature of pain, its management, and its intersection with mental health and addiction. Here are some highlights from his enlightening discussion.</p>



<h3 class="wp-block-heading">The Subjectivity of Pain</h3>



<p class="wp-block-paragraph">Dr Gurgius emphasised the subjective nature of pain, stating:</p>

<p class="wp-block-paragraph">This distinction is critical, especially in cases of <a href="https://chronicpainaustralia.org.au/resources/" target="_blank" rel="noreferrer noopener"><strong>chronic pain</strong></a>, which persists beyond three months and lacks a clear correlation with visible tissue damage.</p>



<h3 class="wp-block-heading">Central Sensitisation: The Glitch in the System</h3>



<p class="wp-block-paragraph">One of the most relatable analogies Dr Gurgius shared was likening the nervous system’s overreaction to a malfunctioning car alarm. “Imagine a car alarm meant to alert you to a break-in going off for just a gust of wind. That’s central sensitisation,” he explained. This “glitch” can occur due to factors like ongoing inflammation, nerve damage, or impaired pain inhibition, making even minor stimuli feel overwhelmingly painful.</p>



<h3 class="wp-block-heading">The Role of Mental Health and Lifestyle</h3>



<p class="wp-block-paragraph">Mental health plays a significant role in pain perception and recovery. Dr Gurgius noted, “People who are depressed or anxious often feel more pain.” This overlap between <a href="https://www.psychiatry.org/news-room/apa-blogs/chronic-pain-and-mental-health-interconnected" target="_blank" rel="noreferrer noopener"><strong>chronic pain and mental health</strong></a> arises because both activate the same areas of the brain and rely on similar neurotransmitters, such as serotonin and noradrenaline. Lifestyle factors, including poor sleep, excessive caffeine, and artificial sugars, can also exacerbate pain by affecting the nervous system’s ability to heal.</p>



<h3 class="wp-block-heading">Rethinking Pain Management</h3>



<p class="wp-block-paragraph">Dr Gurgius challenged traditional approaches to pain management, cautioning against an over-reliance on opioids. “One in five people prescribed opioids long-term becomes addicted,” he warned. Instead, he advocates for comprehensive pain education programs and alternative therapies like physical activity, psychological support, acupuncture, low-level laser therapy and nerve blocks.&nbsp;</p>



<h3 class="wp-block-heading">Pain and Addiction: Breaking the Cycle</h3>



<p class="wp-block-paragraph">Addiction complicates pain treatment, often creating a vicious cycle where withdrawal intensifies pain and patients feel trapped. Dr Gurgius highlighted the importance of addressing addiction as part of pain management. His dual training in pain and addiction medicine enables him to approach these cases with a holistic lens.</p>

<p class="wp-block-paragraph">Dr Gurgius shared stories of patients who found relief simply through understanding their condition. “When patients know what’s happening, many feel empowered and improve without further intervention,” he noted. <p class="wp-block-paragraph">In recent years, significant strides have been made in <a href="https://theconversation.com/we-looked-at-genetic-clues-to-depression-in-more-than-14-000-people-what-we-found-may-surprise-you-227779">uncovering the genetic underpinnings of mental health</a> conditions like depression. While these breakthroughs offer fascinating insights, they don’t necessarily change the clinical approach to diagnosing or treating depression. Red Health spoke with two of our leading medical experts, Clinical Psychologist and Clinical Neuropsychologist <a href="https://surepsychology.com.au/" target="_blank" rel="noreferrer noopener"><strong>Dr Simone Shaw</strong></a> and Clinical Psychologist <a href="https://grantblakepsychology.au/" target="_blank" rel="noreferrer noopener"><strong>Dr Grant Blake</strong></a>, to explore how these findings align with their practice.</p>



<h3 class="wp-block-heading">Genetics and Depression: A Complex Relationship</h3>



<p class="wp-block-paragraph">Depression is far from a uniform experience. As Dr Simone Shaw points out, “Depression manifests differently in each person, with a complex interplay of biopsychosocial factors.” For some, it’s the cognitive challenges—like trouble concentrating—that dominate. For others, it may be the emotional toll, such as persistent sadness or irritability.</p>



<p class="wp-block-paragraph">The research recently highlighted by <a href="https://theconversation.com/we-looked-at-genetic-clues-to-depression-in-more-than-14-000-people-what-we-found-may-surprise-you-227779" target="_blank" rel="noreferrer noopener"><strong>The Conversation</strong></a> touches on genetic predispositions, but for our experts, this isn’t groundbreaking. While the presence of genetic markers for depression may be novel for some, Dr Shaw stresses that mental health professionals have long recognised the role of genetics, alongside environmental factors.</p>



<h3 class="wp-block-heading">Epigenetics: A Bridge Between Genes and Environment</h3>



<p class="wp-block-paragraph">Dr Shaw explains that epigenetics—how environmental factors influence gene expression—sits at the heart of the biopsychosocial model. “Epigenetic modifications can affect how genes related to mental health are expressed,” she says. This explains why two people with similar genetic risk factors may experience very different mental health outcomes, depending on their life experiences.</p>



<p class="wp-block-paragraph">From childhood adversity to ongoing stress, the environment shapes the brain’s response to challenges. And, importantly, these changes are modifiable, giving us hope for interventions that could alter a person’s mental health trajectory.</p>



<h3 class="wp-block-heading">Clinical Implications: Does This Change Treatment?</h3>



<p class="wp-block-paragraph">Despite these genetic insights, Dr Grant Blake emphasises that this research does not alter how mental health professionals diagnose or treat depression. “It is not standard practice to genetically test patients,” says Dr Blake. “While these findings support existing models of depression, they don’t shift the clinical process.”</p>



<p class="wp-block-paragraph">Instead, he continues to use a comprehensive evaluation of a patient&#8217;s thoughts, behaviours, and emotional reactions. “The findings reinforce that depression is about more than genetics. It’s how someone thinks, feels, and interacts with the world around them,” says Dr Blake.</p>



<h3 class="wp-block-heading">Looking Ahead: Where Does This Research Take Us?</h3>



<p class="wp-block-paragraph">While genetic markers for depression offer a new layer of understanding, it’s clear that clinicians continue to rely on a broader picture. Dr Shaw and Dr Blake agree that the future of mental health treatment will likely involve more personalised care. This includes considering genetic, psychological, and social factors to provide the most effective interventions.</p>



<p class="wp-block-paragraph">As research continues, one thing remains clear: depression is a multifaceted condition that requires a nuanced approach. Genetic markers may help explain predispositions, but the environment, personal experiences, and the support we receive are equally crucial in shaping mental health outcomes.</p>

<h3 class="wp-block-heading">Mark Hayes on Genetic Markers for Mental Health</h3>



<h4 class="wp-block-heading"><strong>Q: Does this information change your department&#8217;s usual advice?</strong></h4>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow">
<p class="wp-block-paragraph">MH: &#8220;No, not really. In most law/compensation arenas, there’s a requirement to &#8220;take the person as they were&#8221; when determining causation.  Predisposition (either genetic or socioeconomic) is largely removed from the equation, because a predisposition doesn’t fatalistically determine an outcome.  For example, I have a predisposition to diabetes based on genetic risk, but I’m not diabetic.  There are other people that have a genetic predisposition to depression, but don’t ever experience it – this might be due to overriding socioeconomic protection, or any number of other reasons.</p>



<p class="wp-block-paragraph">Further, ongoing treatment of psychological conditions is generally adaptive, in that the first treatment performed rarely provides for total cessation of symptoms. Treatments are normally titrated/increased/changed based on the results of the individual. Because the Medical Expert providing an IME doesn’t have the ongoing treatment relationship with the Examinee, the Medical Expert can only provide more common and generalised treatment recommendations, with the understanding that at all times, the treating practitioner should be responsible for adapting treatment regimes if/as required.&#8221;</p>

<h4 class="wp-block-heading"><strong>Q: Is this common knowledge in the legal industry?</strong></h4>

<p class="wp-block-paragraph">MH: &#8220;Not really, but there isn&#8217;t a strong need for it to be.&#8221;</p>

<h4 class="wp-block-heading"><strong>Q: What outcomes could arise from this information?</strong></h4>

<p class="wp-block-paragraph">MH: &#8220;In the short term, I don’t foresee any real change here.  As this field of study progresses and more information is readily available, and in combination with increased genetic marker testing, there may be precedent set where a predisposition has an impact on the eligibility for compensation of an individual, but I think this will be some time away, and opens a big can of worms in terms of employability of an individual in general. To me it creates a slippery slope where genetic testing could eventually be used for exclusion – i.e you have a predisposition to XX, therefore you can’t be employed as YY.&#8221;</p>

<p class="wp-block-paragraph">VH: &#8220;No, the insights from the article reinforce the biopsychosocial approach, which is adopted by our medical experts, who are both clinically active and aligned with up-to-date guidelines. As appropriate to their speciality, they consider a comprehensive range of factors when forming their independent medical opinions &#8211; which may include genetic predispositions.&#8221;</p>

<h4 class="wp-block-heading"><strong>Q: Is this common knowledge in the legal industry?</strong></h4>

<p class="wp-block-paragraph">VH: &#8220;In my opinion and experience, the biopsychosocial model is well understood in the legal industry. However, the role of genetics, particularly given the recent changes to life insurance and TPD policies, is less familiar. The recent ban on insurers using genetic tests for risk assessments highlights a growing awareness of genetic factors (<a href="https://www.abc.net.au/news/2024-09-10/life-insurers-banned-from-using-genetic-tests-to-deny-cover/104333828?utm_campaign=abc_news_web&amp;utm_content=link&amp;utm_medium=content_shared&amp;utm_source=abc_news_web" target="_blank" rel="noreferrer noopener">Life insurers banned from using genetic tests to deny cover or hike premiums &#8211; ABC News</a>). As always, the medico-legal industry will adapt, especially once key players like insurers and government bodies begin integrating such advancements into their practices.&#8221;</p>

<h4 class="wp-block-heading"><strong>Q: What outcomes could arise from this information?</strong></h4>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow">
<p class="wp-block-paragraph">VH: &#8220;While genetic testing isn’t currently a regular feature in our assessments, the insurance ban example illustrates how genetics may gradually become more relevant. We may see clients increasingly ask for our medical experts to comment on the role of pre-existing genetic factors. However, widespread integration of genetic testing into medico-legal contexts will take time and not one that I predict anytime soon.&#8221;</p>

<h4 class="wp-block-heading">Vanessa&#8217;s Final Thoughts</h4>

<p class="wp-block-paragraph">The legislative changes around genetic testing and insurance offer a glimpse of how external shifts can impact our industry. Although genetics is not central to our current evaluations, this may evolve as more clients recognise its relevance in TPD and personal injury claims. <p class="wp-block-paragraph">In my opinion, individuals should not be discouraged from genetic testing, as it serves as a crucial tool for early risk identification. Unfortunately, we see a similar issue in mental health, where seeking professional support is often met with stigma, implying something is wrong, rather than viewing it as part of a proactive wellness routine. If people could visit a mental health professional regularly without fear of judgment or repercussions, the benefits would be immense. From reducing chronic illness, suicide rates, and reliance on prescription medications to easing pressure on the healthcare system, lowering crime, and improving overall well-being, the positive impact is far-reaching.</p>



<p class="wp-block-paragraph">Similarly, genetic testing can empower individuals to take preventive action, such as those carrying the BRCA gene, who are more likely to undergo screening and catch potential issues early. This benefits not only the individual through better health outcomes but also insurers by reducing the long-term costs of treating advanced illnesses. The potential upside of genetic testing is clear, both for healthcare and the insurance industry.</p>

It can be common practice to seek medical input from the worker’s treating practitioners, however, this is not always accessible nor reliable for the employer. In such cases, incorporating a Functional Capacity Assessment can provide valuable insights into the worker&#8217;s physical abilities and limitations, aiding in the development of effective return-to-work strategies.</p>



<p class="wp-block-paragraph">Employers are required to manage injured or ill workers in accordance with workplace health and safety legislation along with organisational policies and procedures. Obtaining independent opinion is common as sometimes this is their only method of gaining clarity and direction for decision making.</p>



<p class="wp-block-paragraph">A Functional Capacity Evaluation (FCE) evaluates an individual’s capacity to perform work activities related to his or her participation in employment.&nbsp;</p>

<h2 class="wp-block-heading">Evaluating Physical and Cognitive Abilities</h2>



<p class="wp-block-paragraph"><a href="https://redhealth.com.au/plus-services/" target="_blank" rel="noreferrer noopener"><strong>Functional Capacity Evaluations (FCEs)</strong></a> are vital for return-to-work planning after an injury or illness. They are generally carried out by one of the following allied health professionals: Occupational Therapist, Exercise Physiologist, Physiotherapist or Clinical Psychologist. The focus of the evaluation is to assess a person’s physical and psychological (inc cognitive) capacity with reference to the inherent requirements of their job duties.&nbsp; The FCE process compares the individual’s health status, and body functions and structures to the demands of the job and the work environment.</p>



<p class="wp-block-paragraph">In essence, an FCE’s primary purpose is to evaluate a person’s ability to participate in work, although other instrumental activities of daily living that support work performance may also be evaluated.</p>

<p class="wp-block-paragraph">The ability to analyse an activity in detail to determine the necessary components to perform the task competently is a core skill of many allied health practitioners, based on their education and training.</p>



<p class="wp-block-paragraph">This is contrary to what many referring customers believe, and it is common for a medical specialist such as an orthopaedic surgeon or occupational and environmental physician to provide opinion on a worker&#8217;s fitness for work through an <a href="https://redhealth.com.au/independent-medical-assessments/" target="_blank" rel="noreferrer noopener"><strong>independent medical examination</strong></a>.</p>



<h3 class="wp-block-heading">The Evaluation:</h3>



<p class="wp-block-paragraph">During a Functional Capacity Assessment the practitioner observes physical and behavioural responses to determine an individual&#8217;s safe capacity to perform the inherent role requirements.&nbsp;</p>



<p class="wp-block-paragraph">For FCEs relating to physical injuries or conditions, physical testing is performed which mimics the job demands (i.e. manual handling &#8211; overhead reach, lifting, pushing etc) to assess the functional ability of the individual.</p>



<p class="wp-block-paragraph">For FCEs relating to psychological conditions, psychological testing is undertaken to evaluate an individual&#8217;s cognitive capacity to perform their tasks at work. The specific testing used will evaluate the individual’s ability to manage the cognitive tasks and psychosocial demands of their role.</p>



<p class="wp-block-paragraph">A Functional Capacity Assessment commonly includes:&nbsp;</p>



<ul class="wp-block-list">
<li>Strength testing through weightlifting, pushing/pulling objects, or carrying items.</li>



<li>Endurance/sustained physical activity like walking or climbing stairs for a set time.</li>



<li>Flexibility to determine the range of motion in different joints through reaching, bending, or twisting exercises.</li>



<li>Maintaining balance tasks, such as walking on a balance beam or catching objects.</li>



<li>Fine motor skills such as writing or manipulating small objects.</li>



<li>Cardiovascular fitness through the measuring of blood pressure at rest and after activity.</li>



<li>Manual handling technique through demonstrated lifting and task completion.</li>
</ul>



<p class="wp-block-paragraph">The practitioner considers the position description, job demands and clinical findings to help determine an individual&#8217;s:</p>

<li>Fitness for duty / work capacity</li>



<li>Ability to safely return to work including hours per day / week</li>



<li>Suitability for alternative roles</li>



<li>Suitable duties and graduated return to work plans</li>

<li>Ability to meet job demands as part of a recruitment process (pre-employment) or following injury or illness (work related or non-work related)</li>



<li>Rehabilitation and treatment needs.</li>

<h2 class="wp-block-heading">Matching Abilities with Job Demands</h2>



<p class="wp-block-paragraph">It is standard practice for the assessor to consider the inherent requirements of the worker’s role when evaluating their work capacity.&nbsp;</p>



<p class="wp-block-paragraph">The assessor will use the position description and job task analysis as provided by the employer along with any other documentation when evaluating the worker. This information is vital for the assessor as it helps them identify the required testing and&nbsp;helps them to understand the inherent requirements of the role. Once the assessor has completed the testing component of the&nbsp;FCE they will&nbsp;use the&nbsp;results of the physical and/or cognitive testing to determine whether the employee&#8217;s current abilities match the role requirements.</p>



<p class="wp-block-paragraph">If there are any incongruencies, the assessor will provide a report which documents the functional restrictions and limitations along with any recommendations they have associated with the employees fitness for duty and return to work. They can also provide recommendations on suitable duties and&nbsp;or environment adjustments, which the employer can utilise when determining next steps. This might involve changes in equipment, work schedules, or practices.</p>



<p class="wp-block-paragraph">Additional resources or support, such as ergonomic assessments, assistive devices, or training on modified work tasks, may be needed to help the employee perform their job effectively and safely.</p>



<h2 class="wp-block-heading">Promoting a Human-Centred Approach</h2>



<p class="wp-block-paragraph">It can be a challenging time for both an employee and employer when navigating illness and injury whether it be work-related or not. Both are often faced with a scenario that is unfamiliar to them which creates a level of concern, worry and frustration. </p>



<p class="wp-block-paragraph">The employee’s understanding of an employer&#8217;s WHS obligations can be limited and often they may be unsure of why medical input is required beyond that provided by their treating practitioner/s. Speaking about their medical condition and how it impacts them may be embarrassing and upsetting, especially where they are being asked to share with their manager or someone who they aren’t familiar with from the workplace.&nbsp;&nbsp;</p>



<p class="wp-block-paragraph">An employer is commonly restricted by the access of information which makes decision making challenging and difficult, particularly when they must adhere to legislative or policy requirements. </p>



<p class="wp-block-paragraph">They often feel in the dark and this is especially the case if an employee is uncomfortable about sharing details of their medical condition. Human Resource, and People and Culture Managers can feel out of their depth when dealing with matters relating to injury or illness as they are concerned, they will worsen the situation by saying or doing something that upsets the worker.</p>



<p class="wp-block-paragraph">Open and transparent&nbsp;communication between parties with a splash of compassion is the most effective approach when dealing with illness or injury within the workplace. Employers should attempt to involve the employee from the early stages right through to the return-to-work planning process. Keeping them informed about the steps being taken and why they are required helps to reduce worry and can make them feel heard.</p>



<h2 class="wp-block-heading">Ensuring Long-Term Success for RTW</h2>



<p class="wp-block-paragraph">A sudden return to full duties can be overwhelming, so a gradual return-to-work plan helps the employee safely and confidently ease into their role and work hours. This graduated method is commonly recommended as it is effective. It also gives the employee the opportunity to condition themselves to their role which reduces the risk of further injury or exacerbation of their symptoms.&nbsp;</p>



<p class="wp-block-paragraph">After the initial return to work, regular monitoring is crucial and can be done through follow-up reviews with treating practitioners, check-ins with supervisors and adjustments to the plan as needed. Emotional support and mental health resources may also be beneficial for a smooth transition. This may be reminders to utilise services such as well-being or EAP services.</p>

<p class="wp-block-paragraph">In November 2022, the Australian Medical Association <a href="https://www.ama.com.au/articles/general-practitioner-workforce-why-neglect-must-end">(AMA) released a report</a> that detailed Australia’s alarming national General Practitioner shortage, which is expected to dramatically worsen by 2031-32 if immediate action isn’t taken.</p>



<p class="wp-block-paragraph">The AMA identified numerous cultural and systemic challenges that have impacted the drop in GP numbers, and recommends swift Government and stakeholder action to minimise the prolonged impact on our healthcare system.</p>



<h2 class="wp-block-heading"><strong>Why is there a GP shortage?</strong></h2>



<p class="wp-block-paragraph">While GP shortages vary significantly between Australian states and territories, metro and rural locations, the AMA research report revealed that there has been a 58.4% <a href="https://redhealth.com.au/why-becoming-a-medico-legal-expert-is-good-for-your-practice/">increase in demand for GP services</a> in the ten years between 2009-2019.&nbsp;</p>



<p class="wp-block-paragraph">The following factors are driving this demand:</p>



<ul class="wp-block-list">
<li>Population growth&nbsp;</li>



<li>An aging population&nbsp;</li>



<li>Increase in the number of visits per person&nbsp;</li>



<li>Increased visit complexity and therefore duration of GP consults</li>
</ul>



<p class="wp-block-paragraph">Compounding the shortage are fewer people studying medicine in general, and of those, fewer are becoming GPs, meaning retiring ones are not being replaced at the usual rates.</p>



<p class="wp-block-paragraph">Many GPs &#8211; particularly post the heights of the Covid pandemic &#8211; are also choosing to work reduced hours in an effort to better support their mental and physical well-being or to spend more time with their families.</p>



<p class="wp-block-paragraph"><a href="https://www.sbs.com.au/news/article/this-gp-is-booked-out-until-next-year-theyre-not-the-only-one/1oghpbggk">This created a perfect storm</a> for a severe GP shortage crisis and is only projected to get worse over the next ten years.</p>



<h2 class="wp-block-heading"><strong>Effects of GP shortages</strong></h2>



<p class="wp-block-paragraph">The long and short term impacts on our healthcare systems due to a shortage of General Practitioners will look like:</p>



<ul class="wp-block-list">
<li>Increased workload for existing GPs</li>



<li>Overworked and stressed practice staff</li>



<li>GPs spending less and less time with patients</li>



<li>Lower quality of care</li>



<li>Prolonged wait times</li>
