<p>This question sits at the heart of a growing legal and commercial challenge for the transport industry and the practitioners who support it. A recent <strong><a href="https://bmcpublichealth.biomedcentral.com/articles/10.1186/s12889-024-20611-9" type="link" id="https://bmcpublichealth.biomedcentral.com/articles/10.1186/s12889-024-20611-9">BMC Public Health</a></strong> meta‑analysis reveals that musculoskeletal disorders (MSDs) are not just common—they are a defining occupational hazard for truck drivers. The study found that <strong>61.75% of drivers have MSDs</strong>, with the <strong>shoulders (31.5%)</strong>, <strong>neck (25.8%)</strong>, and <strong>lower back (23.5%)</strong> estimated as most frequently affected.</p>



<p>These conditions are closely associated with <strong>prolonged sitting, whole</strong>‑<strong>body vibration, awkward postures, and repetitive manual tasks</strong>, such as securing loads and operating vehicle components. Psychological stressors and poor ergonomic design further compound the risk of injury.</p>



<p>To explore the practical and medico‑legal implications of these findings, we spoke with <strong>Dr Peter Johnstone</strong>, an Orthopaedic Surgeon from our <a href="https://redhealth.com.au/red-health-referral-network-download/" type="page" id="2600">Red Health Referral Network</a>. His insights offer a clinical and operational perspective on how these risks intersect with legal principles such as <strong>foreseeability, duty of care, and vicarious liability</strong>, and why they matter for insurers, employers, and solicitors.</p>

<p>Nonetheless, <strong>foreseeability and system design remain primary determinants of liability</strong>. </p>



<h3 class="wp-block-heading"><strong>Vehicle Standards and Employer Responsibility</strong>&nbsp;</h3>



<p>Driver ergonomics are heavily shaped by vehicle design and maintenance. While&nbsp;<strong>Australian Design Rules (ADRs)</strong>&nbsp;mandate compliance for new vehicles, these standards are&nbsp;<strong>not applied retrospectively</strong>&nbsp;to older fleets.&nbsp;</p>



<p>Dr Johnstone emphasises the importance of vibration control:&nbsp;</p>

<h3 class="wp-block-heading"><strong>Physiological and Psychological Injury: Cumulative Strain, Fatigue, and Degeneration</strong>&nbsp;</h3>



<p>Truck driving exposes workers to sustained whole‑body vibration, prolonged sitting, repetitive manual tasks, awkward postures, and irregular or extended working hours. The metaanalysis confirms that seemingly low‑grade physical strains can accumulate over time into chronic musculoskeletal conditions if left unaddressed. These physiological injuries most commonly affect the back, neck, shoulders, and knees, and are closely tied to ergonomic shortcomings and ongoing exposure to vibration and load‑handling tasks. </p>



<p>Beyond the physical demands, prolonged driving hours, isolation, and fatigue contribute significantly to psychological injury. Comcare data&nbsp;indicates&nbsp;that&nbsp;<strong>one in five drivers under the age of 35 experiences severe psychological distress</strong>, far exceeding national workforce averages. Psychological harm is increasingly recognised in claims and&nbsp;frequently&nbsp;interacts with physical injury, compounding pain&nbsp;perception, delaying recovery, and complicating&nbsp;return‑to‑work&nbsp;planning. As a result, both physical and psychological risks must be considered together as part of an integrated system of work health and safety control.&nbsp;</p>



<p>Dr Peter Johnstone’s clinical experience highlights how routine driving tasks, when combined with fatigue and cumulative exposure, predispose drivers to injury. He&nbsp;observes&nbsp;that back pain and other musculoskeletal injuries are commonly precipitated by sitting posture, repetitive vehicle tasks, and poor maintenance:&nbsp;</p>

Consequently, early reporting, ergonomic design, diligent vehicle maintenance, fatigue management, and mental health support all sit squarely within an employer’s control and form critical components of a safe system of work. <p>Do you see patterns in injury severity that correlate with specific job tasks or conditions described in the study?</p>



<p>The back pain that is precipitated often relates to sitting posture, pulling of side curtains, removing of side gates, opening of doors, and poor vehicle maintenance, such as improper functioning of air seats, as well as getting in and out of the vehicle.</p>

<p>Obviously, a detailed history of the injury v. prior regional injuries and symptoms needs to be undertaken.   </p>



<p>However, it is highly probable that a high percentage of truck drivers will have underlying degenerative conditions that&nbsp;remain&nbsp;asymptomatic, until they meet a specific injurious event.&nbsp;&nbsp;Then, underlying changes may cause a delay in full&nbsp;recovery, or&nbsp;continued ongoing pain and function disturbance.&nbsp;&nbsp;</p>



<p>This is clearly seen in the neck, back, shoulders, and knees especially.&nbsp;&nbsp;&nbsp;</p>



<p>As the truck driving community continues to work into older age, we will see more underlying degenerative changes being made symptomatic and requiring treatment.&nbsp;&nbsp;This often leads to the underlying cause needing to be treated as well,&nbsp;in order to&nbsp;get injury symptoms resolution, in particular pain resolution.&nbsp;&nbsp;&nbsp;</p>



<p>The differentiation between occupational exposure v. incidental or lifestyle-related changes, needs to be reviewed and assessed on a&nbsp;case by case&nbsp;basis.</p>

<p><strong>Dr Robert Bourke&nbsp;</strong>is a Clinical Neuropsychologist who helps people understand changes in their thinking, memory, and behaviour through evidence‑based, compassionate assessment. <p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q1: Why did you choose to become a <strong>Neuropsychologist</strong>?</strong></mark></p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-b2558ca64c7cf254fb1076d8b6b36537"><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">&#8220;</mark>I did not initially plan to pursue a career in neuropsychology. My early training was in prosthetics and orthotics, driven by a desire to work in healthcare with a strong emphasis on direct patient care. At the time, I was not fully aware of the field of neuropsychology.&nbsp;</p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-e6a88156356f299348d8190626659735">However, during my undergraduate training, I was introduced to the discipline and was&nbsp;immediately&nbsp;drawn to its unique integration of scientific principles and focus on brain function and behaviour, along with interesting cases of individuals who could not learn&nbsp;new information.&nbsp;</p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-997b6efaae4e56063a9140baff97b1e4">The opportunity to apply scientific knowledge in a clinical context to help individuals understand and manage cognitive, behavioural, and emotional changes deeply resonated with me. I have also found applying neuropsychology within a medicolegal context to be both valuable and engaging.<mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">&#8220;</mark></p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-d92e0b2b8ae33414fa6d37c756cfafd2"><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q2: What has been the highlight of your career so far?<br></strong>“</mark>Managing the Neuropsychology Unit at a large teaching hospital in Victoria during the COVID-19 pandemic stands out as one career highlight. I led a team of senior and junior neuropsychologists through the challenges of the COVID-19 pandemic. </p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-6e82ea4a30f3b16e21911a2072d0fbba">Given that neuropsychology traditionally relies on face-to-face contact and in-person cognitive assessments, we had to be agile and adapt quickly to telehealth models to ensure continuity of care. In addition to supporting patients with a range of cognitive and behavioural conditions, other career highlights include teaching and mentoring early-career and senior&nbsp;neuropsychologists and&nbsp;being appointed Lead Neuropsychologist within the Cognitive Neurology Service at The Royal Melbourne Hospital.&nbsp;<mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">&#8220;</mark></p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-0bb9aa25dd0dd4a552dd097f159db175"><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q3: What do you like to do in your free time?<br></strong>“Bikes. Anything and everything bikes, especially mountain bikes. I have been riding mountain bikes for over 35 years. I am thinking about bikes right now.”</mark></p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-f2175465a3b9281a9fb58d94ba8b2254"><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q4: If you could have dinner with anyone, alive or dead, who would it be and why?<br></strong>“Arnold Schwarzenegger. <br>Our evening would begin at the gym, earning our dinner over a heavy weights session. Later, over a protein-rich meal of almost uncooked steak (minimal carbs), he would share stories from his bodybuilding career, Hollywood days, and political life.”</mark></p>

I survived, but my dignity was dinted. Turns out soaring through the skies is not for everyone.  I now keep my feet, and hobbies, firmly on the ground.<mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">&#8220;</mark></p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-92af5f33c1b6fa122b16d11ad6e29b10"><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Do you prefer cats or dogs?<br></strong>“</mark>If you asked me a year ago, I would have confidently said I was Team Dog. But then Freddie, a tuxedo cat full of charm, personality, and a surprising number of cuddles, entered my life. </p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-0a4ff330121a6ed10ae558b0b36d6c4b">Since then, he has been gradually (and occasionally forcefully) nudging me toward the feline side. These days, I spend a fair amount of time keeping up with his ever-growing list of demands, mostly&nbsp;centred&nbsp;on food and cuddles. My dog, understandably, is not thrilled with this shift. At this point, I call it a draw.<mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">”</mark></p>

With a passion for holistic, patient-centred care and extensive experience across both inpatient and outpatient settings, Dr Hanna brings deep clinical insight and a warm, compassionate approach to her practice.</p>



<p><strong>Professional Background</strong></p>



<p>Dr Hanna’s journey into psychiatry began after her internship, when a locum placement confirmed her calling to the field. Since then, she has built a rich career working across diverse clinical populations and settings. She has held consultant roles in private practice at Epworth Clinic and The Melbourne Clinic, as well as serving as a Consultation Liaison Psychiatrist at Brunswick Private Hospital and John Fawkner Private Hospital.</p>



<p>Her locum work has also taken her across Australia, from youth inpatient units at Dandenong Hospital to regional services at Mildura Base Hospital. Earlier in her career, Dr Hanna trained extensively as an Advanced Trainee and Psychiatry Registrar, gaining experience in old age psychiatry, eating disorders, homelessness outreach, and acute inpatient care.<br><br>Dr Hanna offers limited online consultations. <p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">&#8220;I was lucky enough to do a psychiatry locum after my internship, and I immediately knew it was the right field of Medicine for me. I loved being able to work with my patients on a deeper level for healing and recovery. I have always been interested in holistic medicine, and especially how the emotional well-being of a person can have such a significant impact on physical health, overall function and quality of life. I also enjoyed the variety psychiatry involves.&#8221;</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q2: What has been the highlight of your career so far?<br></strong> “That’s a tricky one, as I have truly enjoyed all my roles in psychiatry, and the variety of jobs I have done. I have to say that I enjoyed being able to locum all around Australia, providing psychiatric care to patients in areas of need. I could do all this whilst exploring many amazing places – truly a wonderful experience.&#8221;</mark></p>

<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q1: Why did you choose to become a Neuropsychologist?<br></strong> “My passion for neuropsychology first stemmed from my desire to work with people, as I am a social and outgoing person who loves to chat! In my undergraduate degree, I worked with a neuropsychologist and from then on I knew that this was the career path for me. </mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">I was drawn to the field as neuropsychology as it involves evidence-based tests and measures that help support your clinical judgement and opinion. Furthermore, I am fascinated by the intricate relationship between the brain and behaviour, and how it manifests differently in varying conditions. But above all, neuropsychology provides an opportunity to work with a diverse range of clients from different backgrounds, injuries and levels of impairment. Building my knowledge and knowing that my assessments, recommendations and compassionate and detailed approach can positively influence the lives of individuals and their families is a deeply motivating factor for me.”</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q2: What has been the highlight of your career so far?<br></strong> “One particularly rewarding experience was 1:1 cognitive rehabilitation work with clients who had suffered severe traumatic brain injuries. Over an extended period I had the privelege of building strong relationships with these clients and their families and it was fulfilling to witness their progress first hand. I developed individualised and innovative strategies, often incorporating technology to enhance their daily living skills despite the severity of their injuries. Seeing such tangible improvements was truly remarkable.”</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q3: What do you like to do in your free time?<br></strong> “I have two young daughters and so most of my free time is spent chasing after them! We spend a lot of time in the pool, at kids birthday parties or playgrounds. Otherwise, this year I have been trying to practice what I preach about healthy ageing, and I have spent more time exercising. I also love a good wine and socialising with friends!”</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q4: If you could have dinner with anyone, alive or dead, who would it be and why?<br></strong> “I would love to learn from Brenda Milner. She is one of the pioneers of neuropsychology and studied the famous patient H.M. Over her long career, she has significantly contributed to understanding the human brain and how brain structures govern learning, memory and speech.”</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Bonus points &#8211; Are you cooking or heading to a restaurant?</strong><br>&#8220;This one is easy &#8211; unless she fancies baked beans on toast for dinner, then definitely a restaurant. Everyone has strengths or weaknesses, and cooking is not on my strength list!&#8221;</mark></p>

<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Tell us something surprising about you<br></strong> “At just 25 years old and despite having no prior medical history or family history, I suffered a stroke with right-sided weakness. During the two weeks I spent in hospital, a multitude of specialists provided both exceptional care but also highlighted some areas where clinicians choice of wording or decisions could improve. </mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">Whilst I am incredibly fortunate that I had no lasting effects from the stroke and it remains a blip in my history, the experience profoundly impacted my clinical style and my understanding of &#8220;patient-centred care&#8221;. As a result, I ensure that my appointments always commence on time, I communicate the process of an assessment, my findings are backed by evidence and I make it a priority to ensure that my reports are completed promptly and that findings are communicated as quickly as possible to avoid unnecessary delays.”</mark></p>

However, having just moved back to Brisbane from a stint in Sydney, the Queensland heat is something else. Most of our time this last Summer was spent in the air conditioning or in the pool.”</mark></p>

<p><strong>Professional Background</strong></p>



<p>A/Prof Harvie’s path into orthopaedics wasn’t a straight one, but that’s part of what makes his perspective so valuable. Initially pursuing cardiac surgery, his early training took him from Oxford to the prestigious Royal Brompton Hospital in London. However, a week into the role, he realised his true calling lay elsewhere: in orthopaedic surgery.</p>



<p>As cardiac surgery positions became increasingly scarce, A/Prof Harvie moved into orthopaedics with the support of his mentors and went on to complete several years of research at Oxford before fully committing to the specialty. Today, his practice is characterised by both a surgeon’s precision and an engineer’s analytical mind, backed by the broad foundation of his original engineering degree. <p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q1: Why Orthopaedic Surgery?</strong><br>&#8220;Honestly, it wasn’t my first choice—I originally wanted to be a cardiac surgeon. But after starting training at the Royal Brompton, I realised it just wasn’t for me. I went back to my mentors in Oxford, and they were incredibly supportive. The timing was a blessing, really—within a few years, many cardiac trainees were told there were no jobs available. Switching to orthopaedics opened up a fulfilling path I might never have found otherwise.&#8221; <br></mark><br><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q2: Career Highlight?<br></strong>&#8220;Getting into medical school at 26 after an engineering degree. It took me a while, but that journey gave me a wider lens than some others in the field. The crossover between analytical problem-solving and hands-on clinical care is where I’ve found my sweet spot.&#8221;</mark><br><br><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q3: What do you enjoy outside of work?<br></strong>&#8220;I go fishing. My dad used to go fishing, so I used to go with him when I was young. I don’t keep anything at all—put most back.</mark> <mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">People still say, &#8220;No, you’re still hurting the fish.&#8221; And my wife always wants me to keep the fish that I catch, but I think I’ve kept maybe five fish in ten years. </mark><br><br><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">We’ve got some great scenery down here, and some of the fishing is a challenge. You target a species—for example, we’ve got kingfish. It took me seven years and two weeks before I caught my first one, and I actually lost one trying to get it in the net..&#8221;</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Q4: Dream Dinner Guest?<br></strong>&#8220;John McEnroe. Because I grew up watching him play, and I thought he was an absolute legend. He changed the sport. He challenged authority, which I sometimes do on occasion, and he could back most of what he said with expertise. And he’s still on TV, and when you hear him talk, people respect what he says. He’s not afraid to tell the truth or offend. He doesn’t pull punches. And he’s got a few other facets—he plays guitar in a rock band. I’ve always found him really interesting to listen to and talk to. No pretensions about himself. Just a very interesting person.&#8221;</mark><br></p>

<p><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">P</mark></strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>ineapple on pizza?<br></strong>&#8220;I’ll eat anything, but I don’t think I’ve ever&nbsp;<em>bought</em>&nbsp;a pizza with pineapple on it. I’m more of a seafood person. Like, if my wife says she’s going out with the girls, I go, &#8220;Great!&#8221; Not because she’s gone, but because I can cook what I want— Seafood pizza with prawn, chilli, garlic—lots of chilli. I’m happy.</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">But if someone gave me a pizza with pineapple on it, I’d eat it. It just wouldn’t be my first choice.&#8221;</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Cats or dogs?<br></strong>&#8220;I’ve always had cats—my first lived to 19. But since moving to Australia, we haven’t had pets. We travel a lot, and cats aren’t quite as popular here.&#8221;</mark></p>



<p><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Summer or winter?<br></strong>&#8220;Summer, no question. I was a teenage lifeguard, love the sea, and Tassie’s weather suits me. We head to Port Douglas most years, and I’ve got some legendary tan lines to prove it!&#8221;</mark></p>

<p>Dr Muir’s career in occupational and environmental medicine began in a unique setting, providing emergency health services to workers on remote oil rigs. This experience ignited her interest in the broad scope of occupational medicine, which spans public health, toxicology, preventative medicine, policy advocacy, and workplace health and safety.</p>



<p>Dr Muir holds Fellowship qualifications and has been recognised with both the Dean Southgate and Ramazzini Prizes during her training. She has represented the Royal Australasian College of Physicians (RACP) in discussions with parliament and policymakers on critical health issues affecting workers, such as silicosis.</p>

Based in Brisbane, Dr Kalhor brings extensive clinical and surgical expertise in upper limb, lower limb, and sports-related orthopaedic conditions.</p>



<p><strong>Professional Background</strong></p>



<p>Dr Kalhor holds a Fellowship from the Royal Australian College of Surgeons (FRACS) with subspecialty training in upper limb and knee surgery. He also holds a Doctorate in Medicine, a Master of Engineering, and a degree in Anatomy. He has held consultant roles in both public and private hospitals across Queensland.</p>

<p>Dr Kalhor completed his Upper Limb and Knee Sports Fellowship at Canberra Orthopaedic Hospital and has worked as an Orthopaedic Consultant at several major hospitals, including the Prince Charles Hospital and QEII Hospital.</p>

<p class="has-vivid-red-color has-text-color has-link-color wp-elements-ff36f271ea7bc7b4b918223dae950b35"><strong>Q1: Why <strong>Orthopaedic surgery</strong>?</strong> <em>&#8220;Growing up, I was always surrounded by adults who were fixing things—mechanics, builders, problem-solvers. That early exposure sparked my curiosity and enthusiasm for understanding how things worked. Later, in high school, I discovered a deep fascination with science. Orthopaedic surgery became the perfect intersection of those two passions: mechanical precision and biological understanding.&#8221;</em></p>



<p class="has-vivid-red-color has-text-color has-link-color wp-elements-7cb8711b108e4def79cd41589fa7b9e6"><strong>Q2: Career Highlight?</strong> <em>&#8220;One of the highlights of my career was a trip overseas where I had the chance to learn a muscle-sparing approach to shoulder replacement—an opportunity that came from simply being in the right place at the right time. Since then, I’ve refined and developed this technique further, and I now perform it in a unique, safe, and highly effective way.&#8221;</em></p>
