<p class="wp-block-paragraph">I was initially drawn to neurology because of the mystery of the brain.&nbsp;Very early&nbsp;in medical school, though, I realised it simply made&nbsp;sense&nbsp;to me. From the first year onwards, neurology felt more intuitive than other systems like cardiology, respiratory, or gastroenterology—it was, in many ways, the path of least resistance.&nbsp;</p>



<p class="wp-block-paragraph">I often joke that I chose neurology because&nbsp;I’m&nbsp;lazy&nbsp;and went with what felt easiest, but there was genuinely something compelling&nbsp;about it. The brain is surprisingly elegant.&nbsp;It’s&nbsp;clean, the major&nbsp;arteries sit on the surface,&nbsp;and structurally&nbsp;it’s&nbsp;like&nbsp;an incredibly dense bundle of tightly packed wires. Even though&nbsp;it’s&nbsp;made up of individual fibres,&nbsp;they’re&nbsp;so closely&nbsp;arranged that the brain feels&nbsp;almost firm—not&nbsp;jelly‑like, just slightly softer than that.&nbsp;</p>



<p class="wp-block-paragraph">With modern imaging like MRI, you can now trace individual fibre pathways, which I find remarkable. That balance of complexity&nbsp;and structure is what&nbsp;ultimately cemented&nbsp;my interest in neurology.</p>

<p class="wp-block-paragraph">I’ve&nbsp;been&nbsp;a&nbsp;neurologist for&nbsp;nearly two&nbsp;decades, but the most meaningful highlight of my career has been over the past few years. In&nbsp;April 2023, I learnt that Fiji—despite having&nbsp;an estimated 10,000 people living with epilepsy—didn’t&nbsp;have&nbsp;a&nbsp;single neurologist. In fact, outside of&nbsp;Australia&nbsp;and New Zealand, none of the Pacific Island nations have resident neurologists, including Papua&nbsp;New Guinea.&nbsp;</p>



<p class="wp-block-paragraph">Once I became&nbsp;aware of that gap, I&nbsp;approached the Fijian government&nbsp;and offered to visit in&nbsp;a&nbsp;purely charitable capacity. Since then,&nbsp;I’ve&nbsp;run more than 76 clinics over the past three years,&nbsp;and&nbsp;it’s&nbsp;been the most gratifying work&nbsp;I’ve&nbsp;done.&nbsp;</p>



<p class="wp-block-paragraph">Fiji is often seen&nbsp;as&nbsp;a&nbsp;luxury holiday destination,&nbsp;and it can be—but the reality inside many public hospitals is&nbsp;very different. Resources&nbsp;are extremely limited. The upside, particularly with epilepsy, is that meaningful improvements&nbsp;don’t&nbsp;require complex infrastructure. Careful&nbsp;history‑taking&nbsp;and&nbsp;sensible changes to medication can have&nbsp;a&nbsp;real&nbsp;and lasting impact on someone’s life. Epilepsy is&nbsp;also my core&nbsp;area&nbsp;of practice, which made this work both practical&nbsp;and personal.&nbsp;</p>



<p class="wp-block-paragraph">So far,&nbsp;we’ve&nbsp;seen&nbsp;around 385 new patients&nbsp;across those clinics, with well over&nbsp;a&nbsp;thousand visits including&nbsp;follow‑ups. Given Fiji’s population,&nbsp;that’s&nbsp;still&nbsp;a&nbsp;small&nbsp;proportion of those who need care, but each patient&nbsp;represents&nbsp;a&nbsp;life that has been directly&nbsp;affected.&nbsp;</p>



<p class="wp-block-paragraph">One of the biggest challenges is the stigma&nbsp;around epilepsy. Despite being more prevalent than breast cancer&nbsp;and multiple sclerosis combined,&nbsp;it’s&nbsp;rarely talked&nbsp;about. Many families keep it private because of longstanding cultural misconceptions.&nbsp;Addressing that silence—helping people understand that epilepsy is common&nbsp;and treatable—has been just&nbsp;as important&nbsp;as the clinical work itself.&nbsp;</p>



<p class="wp-block-paragraph">I’ve&nbsp;informally named this initiative the Ocean Project. It&nbsp;isn’t&nbsp;a&nbsp;registered charity,&nbsp;and&nbsp;there’s&nbsp;no funding or donations involved. I travel for&nbsp;a&nbsp;week&nbsp;at&nbsp;a&nbsp;time, moving&nbsp;across the island with the support of local doctors who give their&nbsp;time&nbsp;and help coordinate clinics. I cover my own travel&nbsp;and&nbsp;accommodation,&nbsp;and together we reach&nbsp;as many communities&nbsp;as we can.&nbsp;</p>



<p class="wp-block-paragraph">Looking&nbsp;ahead, my&nbsp;aim&nbsp;is to extend this work into other Pacific nations, particularly Papua&nbsp;New Guinea. Fiji was the natural starting point because it has&nbsp;a&nbsp;relatively more&nbsp;structured healthcare system, but the need elsewhere is just&nbsp;as urgent. It takes&nbsp;time&nbsp;to first show that there is&nbsp;a&nbsp;problem,&nbsp;and then to show that practical, sustainable solutions&nbsp;are possible.&nbsp;It’s&nbsp;work I believe in strongly,&nbsp;and it&nbsp;continues to be the most rewarding chapter of my career.&nbsp;&nbsp;</p>

<p class="wp-block-paragraph">That was&nbsp;probably the&nbsp;hardest part. It took close to&nbsp;a&nbsp;year to build trust. I began those&nbsp;conversations in 2022,&nbsp;and there was initially&nbsp;a&nbsp;lot of scepticism. People understandably wanted to know why I was doing this&nbsp;and what my motivation was.&nbsp;</p>



<p class="wp-block-paragraph">At one point, I even put it in writing that I would never charge patients in Fiji. I was completely comfortable with that. I was&nbsp;already satisfied with my work here,&nbsp;and this was never&nbsp;about financial gain. For me, it was simply&nbsp;about&nbsp;contributing what I could.&nbsp;</p>



<p class="wp-block-paragraph">All&nbsp;I was offering was my&nbsp;time&nbsp;and my skills. It&nbsp;wasn’t&nbsp;a&nbsp;financial sacrifice so much&nbsp;as&nbsp;a&nbsp;personal commitment. Over&nbsp;time, once it became clear there was no hidden&nbsp;agenda—no intention to set up&nbsp;a&nbsp;private practice or pursue&nbsp;anything for personal benefit—people became more comfortable&nbsp;and supportive.</p>

<p class="wp-block-paragraph"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color"><strong>Dr Balaji Kalband</strong></mark></strong></mark></strong></p>



<p class="wp-block-paragraph">I’ve&nbsp;taken what I call&nbsp;a&nbsp;three‑part&nbsp;approach, which I refer to&nbsp;as the PED model: provide, empower,&nbsp;and develop.&nbsp;</p>



<p class="wp-block-paragraph">The first step is providing care—being there&nbsp;and helping patients—which is where most of my focus has been so far.&nbsp;</p>



<p class="wp-block-paragraph">The second step is empowerment. I want to teach local doctors&nbsp;and medical students how to recognise&nbsp;and manage epilepsy. While it may be some&nbsp;time&nbsp;before these regions have&nbsp;full‑time&nbsp;neurologists, you&nbsp;don’t&nbsp;need to be&nbsp;a&nbsp;neurologist to diagnose epilepsy. With the right training, these skills can be taught.&nbsp;</p>



<p class="wp-block-paragraph">The third step is development.&nbsp;Access to medication is limited, so part of my role is&nbsp;advocating for better investment in&nbsp;appropriate treatments&nbsp;and basic infrastructure.&nbsp;</p>



<p class="wp-block-paragraph">Right now, simply providing care is&nbsp;already&nbsp;a&nbsp;major undertaking, but the&nbsp;long‑term&nbsp;impact will come from empowerment. Epilepsy is one&nbsp;condition where you&nbsp;don’t&nbsp;need sophisticated testing—often&nbsp;a&nbsp;good clinical history&nbsp;and&nbsp;sensible medication changes can make&nbsp;a&nbsp;profound difference.&nbsp;</p>



<p class="wp-block-paragraph">Sustainability matters to me. I might be&nbsp;able to see&nbsp;a&nbsp;proportion of patients over the next couple of decades, but epilepsy&nbsp;isn’t&nbsp;going&nbsp;away. Lasting change means building local&nbsp;capacity&nbsp;so care&nbsp;continues well beyond my involvement.&nbsp;</p>

<p class="wp-block-paragraph">In my spare&nbsp;time,&nbsp;I’ve&nbsp;been working on&nbsp;a&nbsp;novel. I was partly inspired by The Book Thief by Markus Zusak, which is set during World War II.&nbsp;</p>



<p class="wp-block-paragraph">My own story is set&nbsp;around the same period but follows&nbsp;a&nbsp;young girl from Poland, with&nbsp;a&nbsp;different perspective. The idea&nbsp;came from&nbsp;an&nbsp;assignment while I was completing&nbsp;a&nbsp;screenplay writing course&nbsp;at the&nbsp;Australian Film&nbsp;and Television Institute,&nbsp;and&nbsp;I’ve&nbsp;been developing it since.&nbsp;</p>



<p class="wp-block-paragraph">Alongside medicine, writing has become something I genuinely enjoy.&nbsp;It’s&nbsp;a&nbsp;different way&nbsp;of thinking&nbsp;and&nbsp;a&nbsp;welcome creative outlet.&nbsp;</p>

<p class="wp-block-paragraph">There’s&nbsp;a&nbsp;Polish poet I&nbsp;greatly&nbsp;admire, Wisława&nbsp;Szymborska, who won the Nobel Prize in 1996—the same year&nbsp;Australia’s Peter Doherty was recognised. I came&nbsp;across her work through Peter Doherty’s biography, where he describes meeting her&nbsp;at the Nobel ceremony,&nbsp;and that stayed with me.&nbsp;She’s&nbsp;someone I would have loved to sit down with&nbsp;and talk to.&nbsp;</p>



<p class="wp-block-paragraph">Among those who&nbsp;are living,&nbsp;I’d&nbsp;choose Tom Hanks. I&nbsp;admire him not just&nbsp;as&nbsp;an&nbsp;actor, but&nbsp;as&nbsp;a&nbsp;storyteller.&nbsp;Across his work,&nbsp;there’s&nbsp;a&nbsp;warmth&nbsp;and thoughtfulness that I find compelling.&nbsp;</p>

<p class="wp-block-paragraph">That’s&nbsp;actually been&nbsp;a&nbsp;recent discovery for me. I never really had&nbsp;an&nbsp;answer—until I got&nbsp;a&nbsp;dog&nbsp;about two years&nbsp;ago.&nbsp;That’s&nbsp;when I&nbsp;realised&nbsp;I’m&nbsp;probably more&nbsp;of&nbsp;a&nbsp;cat person.&nbsp;</p>



<p class="wp-block-paragraph">I&nbsp;adore my dog&nbsp;and love him dearly—he’s&nbsp;wonderful—but he does need&nbsp;a&nbsp;lot of&nbsp;attention. Having him has made me realise that,&nbsp;at heart,&nbsp;I’m&nbsp;a&nbsp;cat person who just happens to have—and very much love—a&nbsp;dog.</p>

My case study was a business continuity and disaster recovery uplift. On paper, it was sensible. In practice, it kept stalling because it crossed operations, technology and risk, without sitting neatly inside any one team. But the kicker is, I was responsible for it.</p>

<p class="wp-block-paragraph">That is the part I think resonates with medico-legal audiences. Plaintiff and defendant lawyers deal with this all the time. The issue may be obvious. The consequence may be serious. But the people shaping the decision, funding the response, carrying the risk and managing the fallout are often not the same people. Good work does not move just because it deserves to.</p>



<p class="wp-block-paragraph">The main learning I shared was simple: I did not unlock momentum by pushing the solution harder. I unlocked it by changing the frame. We stopped talking about the cost of the solution and started talking about the cost of failure. Once the business could see what inaction actually meant, the conversation changed. The question stopped being ‘why invest?’ and became ‘why are we still comfortable with this level of risk?’</p>



<h4 class="wp-block-heading">It’s like the old roof on the old family Queenslander. We’re dry now, but if we have another “10-year flooding event” in the next 2 years, will it still be okay?</h4>

<p class="wp-block-paragraph">That shift matters in legal settings too. Whether you are coordinating a plaintiff matter across experts and evidence, or managing a defence matter across insurers, clinicians and internal stakeholders, influence often comes down to translation. You have to express the issue in terms the next decision-maker cannot sidestep. Not more words. Better framing.</p>

<p class="wp-block-paragraph">The second learning was that over-explaining is not the same as influencing. Early on, I tried to build the perfect case before bringing others in. What I learned instead was that too much detail can actually give people more room to delay. The better move was to engage the right stakeholders earlier, make the risk visible, and let ownership spread before the ask became urgent.</p>

<p class="wp-block-paragraph">The third learning was about restraint. When you are carrying accountability without formal authority, there is a temptation to compensate by doing more, proving more and holding more. I think that is where people burn out. Real influence is often lighter than that. Be clear on the problem. Be specific about the consequence. Bring people in early enough that the issue becomes shared.</p>



<p class="wp-block-paragraph">That, for me, was the real point of the session. Influence is not about charm. It is not about hierarchy. It is about helping people see why something matters before the cost of delay gets chosen by default. For legal professionals working in complex medico-legal environments, that is not a nice-to-have skill. It is part of the job.</p>

<h3 class="wp-block-heading">Last Christmas, Red Health invited clients, medical experts and team members to help decide how our <strong>$10,000 Christmas donation</strong> would be shared across three important charities.</h3>



<p class="wp-block-paragraph">At Red Health, we believe giving should be more than a gesture. It should reflect who we are, what we value, and the community we work with every day. That’s why, as part of our A Charitable Matter initiative, we invited our stakeholders to help shape the distribution of our 2025 Christmas donation.</p>



<p class="wp-block-paragraph">In 2025, Red Health committed $10,000 in total to three charities: <a href="https://www.childhood.org.au/" type="link" id="https://www.childhood.org.au/">Australian Childhood Foundation</a>, <a href="https://www.projectrespect.org.au/">Project Respect</a>, and <a href="https://www.msf.org/">Médecins Sans Frontières</a> (Doctors Without Borders). Rather than deciding the split internally, we asked our clients, medical experts and team members to participate in an anonymous vote and tell us which cause mattered most to them.</p>



<p class="wp-block-paragraph">Each stakeholder received one anonymous vote, helping create a donation outcome that reflected the collective voice of the Red Health community. The allocation model was simple and transparent: the charity with the most votes would receive $6,000, while the other two charities would each receive $2,000.</p>



<p class="wp-block-paragraph">This initiative was built around a simple idea: if giving is part of our culture, then the people who shape our business should have a chance to shape our impact too. In that sense, A Charitable Matter is about more than donating funds. It is about making generosity transparent, participatory and aligned with the human side of our brand.</p>



<h4 class="wp-block-heading">The 2025 Results</h4>



<p class="wp-block-paragraph">Thanks to everyone who took part in the vote, we’re pleased to share the outcome of Red Health’s 2025 Christmas giving initiative. Based on stakeholder votes, Project Respect received the highest level of support and received the major donation of $6,000. Australian Childhood Foundation and Médecins Sans Frontières each received $2,000.</p>

<p class="wp-block-paragraph">Voting was tight across the board, with our clients in the medico-legal industry most evenly split across the three charities.</p>

<h4 class="wp-block-heading"><strong>The Charities We Supported</strong></h4>



<p class="wp-block-paragraph">This year’s recipients were selected because they reflect causes that matter deeply to Red Health and align with the values we want to put into practice. The three charities supported through <strong>A Charitable Matter</strong> were:</p>



<ul class="wp-block-list">
<li><strong>Australian Childhood Foundation</strong>, which works to protect children and restore childhood through care, safety and healing. </li>



<li><strong>Project Respect</strong>, a specialised support and referral service for women and gender diverse people with experience in the sex industry and those who have experienced sexual exploitation, including trafficking.</li>



<li><strong>Médecins Sans Frontières</strong> (Doctors Without Borders), an independent international medical humanitarian organisation delivering emergency aid in countries affected by conflict, epidemics, disasters and healthcare exclusion.</li>
</ul>



<p class="wp-block-paragraph">As a female-led organisation working closely with the medical community, Red Health was proud to support charities focused on empowering children, women and humanitarian emergency aid.</p>



<h4 class="wp-block-heading">More Than a Christmas Donation</h4>



<p class="wp-block-paragraph">What made this initiative special was not just the donation itself, but the way it brought our community into the process. By inviting participation from the people we work with every day, we turned a traditional Christmas donation into something shared. It became a reflection of the Red Health community, not just a decision made behind closed doors.</p>



<p class="wp-block-paragraph">That matters because meaningful actions are the ones people can see, understand and feel part of. <strong>A Charitable Matter</strong> gave us the opportunity to live our values in a way that was practical, transparent and community-led.</p>



<h4 class="wp-block-heading"><strong>Thank You</strong></h4>



<p class="wp-block-paragraph">To every client, medical expert and team member who took the time to vote: thank you. Your participation helped shape this year’s donation and made the campaign what it was — a genuine reflection of shared values and collective impact. <p class="wp-block-paragraph">Ms Prendergast has worked across adult and youth mental health, research, and private practice settings and has provided neuropsychological assessment and care through her Brisbane-based practice since 2007. She has particular expertise in assessing brain injury and a wide range of clinical presentations, drawing on her extensive experience to deliver thorough, evidence-based evaluations.</p>

<p class="wp-block-paragraph">Neuropsychology really feels like the natural intersection of my interests and experience.&nbsp;I’ve&nbsp;always been drawn to the medical side of psychology — understanding the specifics of an injury or neurological condition and how that translates into changes in thinking, memory, and day-to-day functioning. I find it both fascinating and meaningful to take complex medical information and help make it understandable and relevant to&nbsp;someone’s&nbsp;lived experience.&nbsp;</p>



<p class="wp-block-paragraph">As a clinical psychologist and clinical neuropsychologist for many years,&nbsp;I’ve&nbsp;spent a great deal of time supporting individuals after injury as they work toward rebuilding their lives and&nbsp;maintaining&nbsp;quality of life. What I value about neuropsychology is the opportunity to meet people after what is often&nbsp;a very difficult&nbsp;or traumatic event and help them make sense of what&nbsp;they’re&nbsp;experiencing. Providing clarity around cognitive changes can be incredibly reassuring and empowering.&nbsp;</p>



<p class="wp-block-paragraph">I also genuinely enjoy working in both assessment and treatment. Assessment offers insight and direction, while treatment provides space for growth and adaptation. Being able to integrate both allows me to support patients not only in understanding their challenges, but in developing practical strategies to move forward with confidence and resilience.&nbsp;</p>

<p class="wp-block-paragraph"><strong>Dr Sigrid Denehey</strong> is a highly experienced Clinical Neuropsychologist who supports individuals across the lifespan with thoughtful, evidence‑based assessments of brain function and cognitive wellbeing. With a long‑standing fascination for the human brain and its ability to reveal pathology even when imaging appears normal, she brings precision, curiosity, and compassion to every assessment she undertakes. </p>



<p class="wp-block-paragraph">Throughout her career, Dr Denehey has worked across acute, community, and rehabilitation settings, with particular expertise in acquired brain injury, neurodegenerative conditions, epilepsy, multiple sclerosis, stroke, and paediatric head trauma.</p>

<p class="has-vivid-red-color has-text-color has-link-color wp-elements-afa899315cb9935ba422d6e217059c67 wp-block-paragraph">&#8220;I was working as a legal secretary whilst completing my undergraduate degree in psychology and law and saw several reports (IMEs) from neuropsychologists come across my desk. I thought what they did, and were able to do, was incredible, especially being able to detect brain pathology despite normal imaging, and, before neuroimaging was even invented, to be able to say where a lesion was in a brain based on their neuropsychological profile. The human brain truly is amazing.<mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">&#8220;</mark></p>

A recent <strong><a href="https://bmcpublichealth.biomedcentral.com/articles/10.1186/s12889-024-20611-9" type="link" id="https://bmcpublichealth.biomedcentral.com/articles/10.1186/s12889-024-20611-9">BMC Public Health</a></strong> meta‑analysis reveals that musculoskeletal disorders (MSDs) are not just common—they are a defining occupational hazard for truck drivers. The study found that <strong>61.75% of drivers have MSDs</strong>, with the <strong>shoulders (31.5%)</strong>, <strong>neck (25.8%)</strong>, and <strong>lower back (23.5%)</strong> estimated as most frequently affected.</p>



<p class="wp-block-paragraph">These conditions are closely associated with <strong>prolonged sitting, whole</strong>‑<strong>body vibration, awkward postures, and repetitive manual tasks</strong>, such as securing loads and operating vehicle components. Psychological stressors and poor ergonomic design further compound the risk of injury.</p>



<p class="wp-block-paragraph">To explore the practical and medico‑legal implications of these findings, we spoke with <strong>Dr Peter Johnstone</strong>, an Orthopaedic Surgeon from our <a href="https://redhealth.com.au/red-health-referral-network-download/" type="page" id="2600">Red Health Referral Network</a>. His insights offer a clinical and operational perspective on how these risks intersect with legal principles such as <strong>foreseeability, duty of care, and vicarious liability</strong>, and why they matter for insurers, employers, and solicitors.</p>

<h3 class="wp-block-heading"><strong>What the Research Reveals</strong>&nbsp;</h3>



<p class="wp-block-paragraph">The&nbsp;meta‑analysis&nbsp;reviewed&nbsp;<strong>15&nbsp;cross</strong>‑<strong>sectional&nbsp;studies involving 2,662 truck drivers</strong>,&nbsp;identifying&nbsp;a consistent pattern of physical strain and ergonomic shortcomings across the industry. It concluded that MSDs are&nbsp;<strong>reasonably foreseeable</strong>&nbsp;given the nature of truck driving work and the cumulative exposure to known risk factors.&nbsp;</p>



<p class="wp-block-paragraph">The research also highlighted significant gaps in <strong>preventive controls</strong>, including inconsistent ergonomic interventions, variable maintenance practices, and limited health monitoring.</p>

<h3 class="wp-block-heading"><strong>Was Harm Predictable?</strong>&nbsp;</h3>



<p class="wp-block-paragraph">Foreseeability in negligence law turns on whether a reasonable employer could&nbsp;anticipate&nbsp;the risk of harm. With&nbsp;<strong>over six in ten drivers reporting MSDs</strong>, and&nbsp;long‑standing&nbsp;evidence linking vibration, posture, and physical loading to injury, the risk profile is well established.&nbsp;</p>



<p class="wp-block-paragraph">Even where individual risk factors vary, the cumulative exposure inherent in truck driving makes injury&nbsp;<strong>predictable rather than exceptional</strong>. As Dr Johnstone notes:&nbsp;</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow">
<p class="wp-block-paragraph"><em>“Truck drivers seem to have a lower rate of injury when compared with bank employees, orthopaedic surgeons and nurses, but a higher rate of injury than fire</em>‑<em>fighters. Clearly, the risk of injury is a function of the physical conditions of employment and the duties they are required to do.”</em> </p>

<p class="wp-block-paragraph">These comparisons do not undermine foreseeability. Instead, they highlight that while risk differs between professions, the risk faced by drivers remains <strong>significant, measurable, and well documented</strong>, necessitating proactive controls. </p>



<h3 class="wp-block-heading"><strong>Contributory Negligence and Individual Risk Factors</strong>&nbsp;</h3>



<p class="wp-block-paragraph">Although employers owe a clear duty to provide a safe system of work, courts may also examine whether a worker’s own conduct contributed to their injury. The&nbsp;meta‑analysis&nbsp;identifies&nbsp;factors such as&nbsp;<strong>high BMI, smoking, poor diet, and multiple chronic conditions</strong>&nbsp;as contributors to injury severity and recovery outcomes.&nbsp;</p>



<p class="wp-block-paragraph">Supporting this, the <strong><a href="https://drivinghealth.net/research/">Comcare Driving Health Project</a></strong> found: </p>



<ul class="wp-block-list">
<li>Almost <strong>one</strong>‑<strong>third of drivers</strong> have three or more diagnosed medical conditions
<ul class="wp-block-list">
<li><strong>One in five truck drivers</strong> under the age of 35 report severe psychological distress</li>



<li>Compared to <strong>one in nine Australian men</strong> the same age</li>
</ul>
</li>



<li><strong>54.3% of truck drivers</strong> are classified as obese, compared with a <strong>national average of 32.5%</strong> </li>
</ul>



<p class="wp-block-paragraph">While these factors do not absolve employers of responsibility, they can influence <strong>apportionment of damages</strong> under contributory negligence principles—particularly where medical advice, training, or health initiatives have been provided but not followed.</p>

<h3 class="wp-block-heading"><strong>Lifestyle Choices and Ergonomic Risk</strong>&nbsp;</h3>



<p class="wp-block-paragraph">The research&nbsp;identifies&nbsp;<strong>prolonged sitting and poor posture</strong>&nbsp;as central ergonomic risk factors. Dr Johnstone explains:&nbsp;</p>

<p class="wp-block-paragraph"><em>Perhaps the incidence of shoulder, back and knee injuries could be limited by managing the postural deficits that seem to befall truck drivers.”</em></p>

<p class="wp-block-paragraph">Nonetheless, <strong>foreseeability and system design remain primary determinants of liability</strong>. </p>



<h3 class="wp-block-heading"><strong>Vehicle Standards and Employer Responsibility</strong>&nbsp;</h3>



<p class="wp-block-paragraph">Driver ergonomics are heavily shaped by vehicle design and maintenance. While&nbsp;<strong>Australian Design Rules (ADRs)</strong>&nbsp;mandate compliance for new vehicles, these standards are&nbsp;<strong>not applied retrospectively</strong>&nbsp;to older fleets.&nbsp;</p>



<p class="wp-block-paragraph">Dr Johnstone emphasises the importance of vibration control:&nbsp;</p>

<p class="wp-block-paragraph">Employers who&nbsp;fail to&nbsp;maintain&nbsp;compliant seating or&nbsp;allocate&nbsp;appropriate vehicles&nbsp;may breach their duty of care. Such failures can also ground&nbsp;<strong>vicarious liability</strong>&nbsp;where supervisors ignore maintenance schedules or driver reports.&nbsp;</p>



<h3 class="wp-block-heading"><strong>An Aging Workforce and Latent Vulnerabilities</strong>&nbsp;</h3>



<p class="wp-block-paragraph">Truck driving is dominated by an older workforce—<strong>average age 48, with 94% male</strong>—which significantly alters injury dynamics. Dr Johnstone notes:&nbsp;</p>

<p class="wp-block-paragraph">As the workforce continues to age, even minor incidents may produce&nbsp;<strong>disproportionate and prolonged disability</strong>, complicating causation&nbsp;analysis&nbsp;and damages assessments in personal injury claims.&nbsp;</p>



<h3 class="wp-block-heading"><strong>Physiological and Psychological Injury: Cumulative Strain, Fatigue, and Degeneration</strong>&nbsp;</h3>



<p class="wp-block-paragraph">Truck driving exposes workers to sustained whole‑body vibration, prolonged sitting, repetitive manual tasks, awkward postures, and irregular or extended working hours. The metaanalysis confirms that seemingly low‑grade physical strains can accumulate over time into chronic musculoskeletal conditions if left unaddressed. These physiological injuries most commonly affect the back, neck, shoulders, and knees, and are closely tied to ergonomic shortcomings and ongoing exposure to vibration and load‑handling tasks. </p>



<p class="wp-block-paragraph">Beyond the physical demands, prolonged driving hours, isolation, and fatigue contribute significantly to psychological injury. Comcare data&nbsp;indicates&nbsp;that&nbsp;<strong>one in five drivers under the age of 35 experiences severe psychological distress</strong>, far exceeding national workforce averages. Psychological harm is increasingly recognised in claims and&nbsp;frequently&nbsp;interacts with physical injury, compounding pain&nbsp;perception, delaying recovery, and complicating&nbsp;return‑to‑work&nbsp;planning. As a result, both physical and psychological risks must be considered together as part of an integrated system of work health and safety control.&nbsp;</p>



<p class="wp-block-paragraph">Dr Peter Johnstone’s clinical experience highlights how routine driving tasks, when combined with fatigue and cumulative exposure, predispose drivers to injury. He&nbsp;observes&nbsp;that back pain and other musculoskeletal injuries are commonly precipitated by sitting posture, repetitive vehicle tasks, and poor maintenance:&nbsp;</p>

<p class="wp-block-paragraph">These latent vulnerabilities mean that fatigue, psychological stress, and delayed reporting can significantly worsen injury outcomes. Consequently, early reporting, ergonomic design, diligent vehicle maintenance, fatigue management, and mental health support all sit squarely within an employer’s control and form critical components of a safe system of work. As Dr Johnstone concludes:&nbsp;</p>

<p class="wp-block-paragraph">Regulatory frameworks governing&nbsp;<strong>fatigue management and rostered hours</strong>&nbsp;exist to limit both safety and health risks. Failure to enforce these systems, or to respond promptly to reported mechanical or ergonomic issues, can strengthen allegations of systemic negligence.&nbsp;</p>



<p class="wp-block-paragraph">Dr Johnstone cautions:&nbsp;</p>

<p class="wp-block-paragraph">The injuries are highlighted for truck drivers, with 32% of shoulder, 26% of neck, 24% of lower back, 22% of knee injuries.  These figures are consistent with the rigours of the occupation.</p>



<p class="wp-block-paragraph">However, truck drivers seem to have a lower rate of injury when compared with bank employees, orthopaedic surgeons and nurses, but a higher rate of injury than fire-fighters.</p>



<p class="wp-block-paragraph">Clearly, the risk of injury is a function of the physical conditions of employment and the duties they are required to do.</p>



<p class="wp-block-paragraph">The article identifies prolonged sitting, whole-body vibration, and awkward postures as key risk factors. How do these exposures typically present in your clinical assessments?</p>



<p class="wp-block-paragraph">Truck drivers are usually driving hard suspension vehicles that transmit a lot of bumps.  Therefore, good air-suspension seats are required to limit the risk of low back pain and vibratory micro-injury.</p>



<p class="wp-block-paragraph">The three-point fixation of climbing in and out vehicle cabs poses a risk to the shoulders, knees and ankle.</p>



<p class="wp-block-paragraph">Poor posture for prolonged periods increases the risk of back pain whilst driving.  This is, however, accentuated by the often poor physical conditioning, poor core strength, obesity, smoking and a general lack of exercise.</p>



<p class="wp-block-paragraph">Perhaps the incidence of shoulder, back and knee injuries could be limited by managing the postural deficits that seem to befall truck drivers. </p>

<p class="wp-block-paragraph">Unfortunately, some activities such as pulling side curtains, removing side gates, opening doors and, lack of vehicle maintenance exposes the driver to risk of injury.</p>



<p class="wp-block-paragraph">Do you see patterns in injury severity that correlate with specific job tasks or conditions described in the study?</p>



<p class="wp-block-paragraph">The back pain that is precipitated often relates to sitting posture, pulling of side curtains, removing of side gates, opening of doors, and poor vehicle maintenance, such as improper functioning of air seats, as well as getting in and out of the vehicle.</p>

<p class="wp-block-paragraph">Obviously, a detailed history of the injury v. prior regional injuries and symptoms needs to be undertaken.   </p>



<p class="wp-block-paragraph">However, it is highly probable that a high percentage of truck drivers will have underlying degenerative conditions that&nbsp;remain&nbsp;asymptomatic, until they meet a specific injurious event.&nbsp;&nbsp;Then, underlying changes may cause a delay in full&nbsp;recovery, or&nbsp;continued ongoing pain and function disturbance.&nbsp;&nbsp;</p>

<p class="wp-block-paragraph">As the truck driving community continues to work into older age, we will see more underlying degenerative changes being made symptomatic and requiring treatment.&nbsp;&nbsp;This often leads to the underlying cause needing to be treated as well,&nbsp;in order to&nbsp;get injury symptoms resolution, in particular pain resolution.&nbsp;&nbsp;&nbsp;</p>



<p class="wp-block-paragraph">The differentiation between occupational exposure v. incidental or lifestyle-related changes, needs to be reviewed and assessed on a&nbsp;case by case&nbsp;basis.</p>
