Introduction

Red Medicine Pty Ltd trading as Red Health Independent Medical Assessments (“we”, “us”, “our”) provides a range of medico-legal services, including the coordination of independent medical examinations (IMEs), file reviews, administrative and logistical support, and the preparation and delivery of medico-legal services for referring clients.

We do not provide diagnosis, treatment, or any therapeutic healthcare services. 
 
This Privacy Statement outlines how we collect, use, disclose, and protect personal information in connection with our services. 

Collection of Personal Information

We collect personal information that is reasonably necessary for arranging, managing, and facilitating our medico-legal services. This may include: 

  • Information provided by referring clients (such as law firms, insurers, employers, or other authorised parties), including health and other sensitive information 
  • General personal information collected directly from examinees, such as name, contact details, date of birth, and confirmation of consent 
  • Information relevant to medico-legal services, including documents provided by referring clients 
  • Website and system-generated information (IP address, device information, cookies, usage analytics) 

We collect sensitive information only where permitted by law, including with consent or where authorised by legislation, legal processes, or the referring party. 

Use of Personal Information

We use personal information to: 

  • Arrange, administer, and facilitate our medico-legal services 
  • Coordinate appointments, file reviews, and other medico-legal activities 
  • Support the preparation and delivery of medico-legal services (including reports) by independent examiners 
  • Communicate with examinees, independent examiners, and referring clients 
  • Comply with legal, professional, and regulatory obligations 

Operate, maintain, and improve our systems, website, and service delivery processes

Disclosure of Personal Information

We may disclose personal information to: 

  • Independent medical examiners or other health professionals engaged to provide medico-legal services as part of our service offerings 
  • Referring clients, such as law firms, insurers, employers, and authorised third parties 
  • Service providers who support our operations, including IT providers, secure storage vendors, communications services, and administrative support services 
  • Courts, tribunals, regulatory bodies, or law enforcement agencies when required or authorised by law (e.g., subpoenas, compulsory notices, statutory requirements) 

Independent medical examiners operate as independent practitioners and may manage their own notes and information in accordance with their professional and legal obligations. 

We do not routinely disclose personal information overseas. If overseas disclosure becomes necessary, we will comply with Australian Privacy Principle (APP) 8.

Data Security

We implement reasonable technical and organisational measures to safeguard personal information, including: 

  • Secure electronic storage systems 
  • Encryption and secure data transfer processes 
  • Role-based access controls 
  • Staff training and confidentiality obligations 
  • Regular system security reviews 

We maintain a comprehensive information security and quality management framework aligned with international standards, including ISO 27001 (Information Security Management Systems) and ISO 9001 (Quality Management Systems). 

Data Retention and Destruction

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected and to comply with legal, professional, and regulatory requirements. Information is securely destroyed or de-identified when no longer required.

  • Request access to personal information we hold about you 
  • Request correction of personal or administrative details you believe are inaccurate 
  • Request deletion of personal information, where permitted by law 
  • Withdraw consent for non-essential uses

Access to medico-legal information

Much of the personal information we hold is collected and used solely for medico-legal purposes and is often: 

  • subject to confidentiality obligations 
  • controlled by the referring client (such as a law firm, insurer, or employer) 
  • subject to legal professional privilege 
  • connected to actual or anticipated legal or insurance processes 

For these reasons, we may not be able to release certain information directly to you. 

In most cases, individuals will be directed to the referring client, who is responsible for determining whether access can be granted.

Corrections

  • We can correct factual information where it is inaccurate. 
  • We cannot amend medico-legal opinions or documents prepared by independent medical examiners.
  • Where a correction is requested but cannot be made, we can record your request for correction and retain this information with our records in accordance with our obligations under the Privacy Act.

Data Breach Notification

If we identify a data breach likely to cause serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches Scheme.
